GENERAL PROVISIONS
This Privacy Policy applies to all persons using the online store operated by us at https://diversesystem.com, which we will refer to as the "Store" or "Online Store" and therefore applies to you, which is why it is so important for you to familiarize yourself with it.
The Policy specifies in particular the principles of collecting and processing your personal data obtained by us both during the registration of an account in the Store, using the Store, in the case of making purchases without creating an account, as well as in the case of starting to subscribe to the Newsletter and in the case of participation in the Diverse Club loyalty program.
If you have any questions, concerns, or comments regarding the processing of your personal data by us, please contact us. Your opinion is most important to us.
WHERE YOUR PERSONAL DATA IS STORED
We store the collected personal data within the European Economic Area.
WHO HAS ACCESS TO YOUR PERSONAL DATA
Only we, the hosting provider and entities providing us with services necessary for the operation of the store have access to your personal data. We never transfer your data to entities with which we do not have signed agreements entrusting the processing of personal data.
If you consent to the processing of your personal data for promotional and marketing purposes, and thus for the purpose of receiving commercial information sent via electronic means of communication, or for the purpose of examining opinions on the level of satisfaction with a purchase made, then we may entrust your personal data to one of the entities cooperating with us. During such processing, your data may be processed in an automated manner for marketing purposes, including in the form of profiling. The consequence of such processing will be the sending of contextual advertising, but only if you give formal consent to the processing of your personal data for marketing purposes.
Apart from the above cases, your personal data will be made available to the relevant state authorities or third parties if such an obligation results from generally applicable law and to the selected carrier or intermediary carrying out shipments on our behalf in order to deliver the ordered goods to you, as well as to an entity handling electronic payments or payments by payment card in order for you to pay for the ordered goods, entities concluding a consumer loan agreement with the Customer for the purchase of goods, entities providing hosting/server services and entities from the IT industry maintaining an online store. Entities participating in the order payment process may process personal data in an automated manner, including in the form of profiling.
We guarantee that in the event that your personal data is processed by entities other than us, we strive to ensure that they provide an adequate level of personal data protection.
On our websites, third parties place information in the form of cookies and other similar technologies on your end device (e.g. computer, smartphone) and gain access to them. These are our trusted partners with whom we constantly cooperate to adapt advertising on our and their websites to your needs and interests, as well as the services that we and our trusted partners provide. Such trusted partners are entities from the capital group of Wirtualna Polska. PURPOSES AND SCOPE OF PROCESSING YOUR PERSONAL DATA
The personal data provided by you will be processed for the purpose and to the extent necessary for registering in the store, concluding and performing the contract, making payments, for direct marketing of our products and services, as well as to enable you to participate in our Diverse Club loyalty program and to examine opinions on the level of satisfaction with the purchase made.
In order to perform the contract, we will process the following data provided by you: name, surname, address, e-mail address, telephone number, tax identification number, company name, delivery address, order history, loyalty card number, gender, date of birth. Additional purposes for which we will process your personal data:
· enabling the provision of the service electronically and full use of the store, including making transactions and paying for purchases
· setting up and managing your account or accounts, and ensuring the maintenance of your account, transactions and resolving technical issues;
· handling complaints in the event that you file such a complaint;
· handling the requests you send to us via :
ü Contact form - the contact form service allows you to send a message on various matters. The contact form is available at the bottom of the home page „diversesystem.com”. In order to use the contact form, you will be required to provide at least the following data: I) name, (II) surname, (III) e-mail address and (IV) telephone number.
ü Chat - the chat service consists of establishing real-time contact between you and consultants via the messenger provided in the Store. First, you will contact a virtual consultant (algorithm), and in the next stage, a physical person.
· contacting you, including for purposes related to the provision of services;
· processing your data for tax and accounting purposes;
· handling the logistics of your order, in particular providing your data to courier companies that will deliver your order;
In order to send you information and commercial materials electronically in the form of a Newsletter, with your consent we will process the e-mail address and telephone number provided by you. The Newsletter service includes receiving commercial information about products offered in the Store via electronic means, including in particular information about the current Store offer, promotions, discounts, marketing campaigns and dedicated promotional offers.
The Seller may provide that the Customer will be entitled to a specific discount for subscribing to the Newsletter service. In such a situation, the Seller will provide appropriate information on the Store's website, along with an indication of the discount amount. The discount code is sent to the Customer by email after subscribing. The discount granted, depending on the conditions provided by the Seller, may be combined with other promotions.
The Customer is entitled to use the content included in the Newsletter only for their own personal use. The use of the above content in any other scope is permitted only on the basis of express prior consent granted by the Seller or another authorized entity in writing under penalty of nullity.
In order to assess your satisfaction with your purchase, we will process the telephone number you provided with your consent.
With your consent, we will also:
· monitor your activity and that of all other users, including keyword searches and managing your activity;
· tailor ads according to content you have previously viewed, tailor offer categories or individual offers based on your activity;
· contact you, including for purposes related to permitted marketing activities, through available communication channels, in particular and with your consent - by e-mail and telephone;
· monitor your activity and that of all other users, e.g. keyword searches, posting offers, conducting research and analysis, among others, in terms of the functionality of this trading platform, improving the operation of services or estimating the main interests and needs of visitors;
· invite you to loyalty programs, competitions and promotional campaigns in which you can participate;
· subject your personal data to automated processing, including profiling, for direct marketing purposes. The effect of such processing may be sending contextual advertising and sharing information about your purchase history, as well as collecting information necessary to make payments.
Based on the legitimate interest of the Administrator or a third party, we process your data for the purpose of:
· conducting statistical analyses;
· storing data for archival purposes, and ensuring accountability (demonstrating our compliance with legal obligations)
Your data will be subject to automated processing, including profiling, for the purpose of providing services related to the performance of the contract and direct marketing. The effect of such processing may be sending contextual advertising and sharing information about your purchase history, as well as collecting information necessary to make payments.
In the event that we intend to further process your personal data for a purpose other than that for which the personal data was collected, we will inform you of that other purpose and provide you with any other relevant information prior to such further processing.
Providing your personal data is voluntary, however, refusing to provide your data will prevent you from using the Store, the App and services provided electronically by us.
If you provide your personal data for the purpose of concluding an agreement with the Online Store, providing your personal data is a condition for concluding this Agreement. Providing personal data in this situation is voluntary, but the consequence of not providing this data will be the inability to conclude an agreement with the Online Store.
In the event of transferring your personal data to the Bank in connection with the handling and settlement of payments made by you to the Online Store via the Internet using payment instruments, the provision of data is required in order to execute the payment and provide confirmation of its execution by the Bank to the Online Store.
In the event of transferring your personal data to the Bank for the purpose of verifying the proper performance of contracts concluded with the Online Store, in particular to ensure the protection of payers' interests in connection with the complaints they submit, providing this data is required in order to enable the performance of the contract concluded between the Online Store and the Bank.
In the event that you provide personal data in connection with the financing of your purchase in the Online Store by PayPo Sp. z o.o. with its registered office in Warsaw (KRS number 0000575158), under the terms of a consumer loan agreement for the purchase of products in the Online Store (tied loan) concluded between you and one of the above-mentioned entities, the transfer of your personal data necessary to conclude the above-mentioned agreement, such as name and surname, address, e-mail address, telephone number, date of birth is a condition for concluding a sales agreement in the Online Store.
BASIS FOR PROCESSING YOUR PERSONAL DATA
The legal basis for our processing of your personal data is:
1) the necessity to perform the contract(s) concluded with you, as well as to take action before concluding such contracts at your request (Article 6, paragraph 1, letter b of the GDPR);
2) processing is necessary to comply with a legal obligation to which we are subject (Article 6 (1) (c) of the GDPR);
3) the legitimate interest of the administrator or a third party, which may be contacting you on various matters, direct marketing and fraud prevention or other activities aimed at securing the interests of the store, including defense and pursuit of claims (Article 6, paragraph 1, letter f of the GDPR);
4) Your consent to the processing of your personal data for promotional and marketing purposes or for the purpose of receiving commercial information sent by electronic means of communication, or for the purpose of measuring satisfaction with a purchase (Article 6, paragraph 1, letter a of the GDPR).
We collect your personal data directly from you or receive it from an online store, of which you are a customer, and we are a trading partner of that store and we have to send you your order (Zalando). Then we receive your identification, address and contact details to pass them on to the courier company.
YOUR RIGHTS

You have the following rights:
1. the right to obtain confirmation from the Controller as to whether your personal data are being processed and, if so, to obtain access to them and the following information:
a) about the purpose, scope and method of processing your personal data,
b) since when your data is processed,
c) the source from which your data comes;
d) recipients or categories of recipients to whom the data is made available;
2. the right to rectify your personal data if it turns out to be incorrect;
3. the right to complete your personal data if it is incomplete;
4. the right to delete your personal data if:
a) the administrator has already achieved the purpose for which the personal data were collected and they are no longer necessary for these purposes,
b) you withdraw your consent to the processing of your personal data for a specific purpose,
c) you object to the processing of your personal data for the purposes of direct marketing, including profiling, to the extent that the processing is related to such direct marketing or you object to the processing and there are no overriding legitimate grounds for the processing of your personal data by us,
d) Your personal data was processed unlawfully,
e) if your personal data must be deleted in order to comply with a legal obligation under Union law or the law of a Member State to which we are subject;
5. the right to limit the processing of your personal data if:
a) you think we are processing it incorrectly - for the period of checking whether you are right,
b) it is found that we are processing your personal data unlawfully, but you object to their deletion and only request the restriction of their processing,
c) we no longer need your personal data for processing purposes, but you need them to establish, pursue or defend legal claims;
d) you object to the processing; then we will limit the processing of your personal data until we determine whether there are no legally justified grounds on our side that override your grounds;
6. the right to transfer your personal data; then you will receive the data you provided to us in a structured, commonly used and machine-readable format, if the processing is based on your consent or is necessary for the performance of a contract concluded with you, as well as necessary to take steps before entering into such a contract at your request;
7. the right to object to the processing of data based on our legitimate interest, including profiling;
8. in the event that we process your personal data for direct marketing purposes, the right to object to the processing of personal data for direct marketing purposes, including profiling;
9. the right to lodge a complaint with the supervisory authority if you believe that our processing of personal data violates the provisions of the GDPR.
WITHDRAWAL OF CONSENT
We allow you to withdraw your consent to our processing of your personal data. If you do not want your personal data to be processed for promotional and marketing purposes or for the purpose of receiving commercial information sent via electronic means of communication, or for the purpose of measuring the level of satisfaction with a purchase, you can withdraw your consent in the manner described above.

PROTECTION OF YOUR PERSONAL DATA BY THE ADMINISTRATOR
We protect your personal data when you make purchases in the Store in accordance with applicable regulations and in accordance with the highest standards of security and data protection.
We ensure the security of personal data by implementing appropriate technical and organizational measures that aim to prevent unlawful processing of data and their accidental loss, destruction and damage. We take all possible measures to ensure that personal data is:
1) correct and processed in a lawful manner;
2) obtained only for specific purposes and not further processed in a way that is incompatible with those purposes;
3) adequate, appropriate and not excessive;
4) accurate and up to date;
5) not stored longer than necessary;
6) processed in accordance with the rights of the persons concerned, including the right to restrict access;
7) safely stored;
8) not transferred without proper protection.
Personal data sets are protected against access by third parties. Only persons authorized by us, trained in the protection of personal data and obliged to keep your personal data confidential are permitted to process your personal data.
Personal data is stored only for the period necessary to perform the contract, the period of subscription to the Newsletter or the period of maintaining an account in the Store, as well as for the period in which the parties may pursue mutual claims resulting from the concluded sales contract or for the period in which we are obliged to store accounting documentation under the regulations.
