Terms & Conditions of the Diverse Club Loyalty Program
1. Introduction
1.1. The subject of the following terms & conditions is to define the rules of participation in Diverse Club Loyalty Program (hereinafter "Program") organized by ETOS S.A. owner of Diverse brand, registered in Gdańsk 80-298, ul. Bysewska 23 (hereinafter "DIVERSE").
1.2. Diverse Club (hereinafter "Club") aims to build a relationship between the program participants (hereinafter "participants") and Diverse, and create special offers for them.
1.3. All regular stationary Diverse stores in Poland and the online store https://www.diversesystem.com are included in the Program. Outlet stores are not included in the Program. In a scope unregulated in the following terms & conditions about shopping in the online store https://www.diversesystem.com, the provisions of these regulations apply:

2. Participants of the Program
2.1. Only adults who are 18 years of age or older can participate in the program
2.2. People excluded from participating in the Program include: employees of ETOS S.A., franchisees, licensees, employees of retail outlets of the "Diverse" chain and members of their families. By family members is meant: ascendants, descendants, siblings, spouses, spouses’ parents and adopted persons.
2.3. A condition for participation in the program is to register the Diverse Club card according to the provisions of art. 3.2 of the following terms & conditions.
3. Loyalty Card – Diverse Club
3.1. Benefits
Owners of the Diverse Club Loyalty Card are entitled to enjoy the benefits set out in the periodic offers dedicated for the participants, including:
- returns, exchanges of the goods without the need to present a receipt for up to 21 days since the day of the purchase,
- complaints about the goods without the need to present a receipt,
- the possibility of using special promotions,
- attractive discounts,
- dedicated offers in the online store and stationary stores.
The discount is assigned to the Diverse Club card; only the owner of the card can use the discount. The discount cannot be handed over to the third party. All correspondence with Program Participants will be done electronically or via SMS. Information about the current benefits for participants will be communicated to them in ways described in the previous sentence. Particular offers and promotions may be limited in time and quantity. Detailed rules of using individual offers and promotional campaigns will be presented and fully explained to participants in messages sent via e-mail. In the event of a conflict between the provisions of these terms & conditions and the content of the offers sent via e-mail, the rules of individual promotional campaigns take precedence, specified individually each time in the correspondence.
3.2. How to receive a card and register in the Program?
To receive the Diverse Club Card, download the Diverse app on Your phone.
To register the card in a way that allows You to participate in the Diverse Club Loyalty Program, correctly fill the registration form in the app. Fill all fields marked with an asterisk, then agree to the conditions for participation in the Program specified in the terms & conditions of Diverse Club Loyalty Program and formally agree to the processing of personal data by DIVERSE. Finish the registration process by clicking the activation link sent on the e-mail address provided during the registration process. If the customer does not register and does not consent to the program’s terms & conditions and processing personal data, including processing for marketing purposes, Loyalty Card will not be activated and will not allow to participate in the Program.
Revocation of previously granted consents, described in the previous paragraph, is unambiguous with withdrawal from participating in Diverse Club Loyalty Program.
3.3. How to use Diverse Club Card
Detailed rules of individual offers and promotional campaigns will be presented and fully explained each time to participants in messages sent via e-mail.
3.4. Card cancellation
DIVERSE reserves the right to cancel the Diverse Club Card in case of being provided false personal data by the participant or in the event of reasonable suspicion of fraud.
4. Returns and complaints
Complaints about the goods purchased with Diverse Club Card as part of individual offers are subject to the same complaint procedure as all other goods purchased in the store, unless specified otherwise in the rules of individual offers.
Returns of the goods purchased with Diverse Club Card/App are possible for 21 days, starting with the day of the purchase or day of the delivery, in case of purchasing goods in the online store.
5. Card damaged or lost
5.1. In case of damaging or losing the card immediately inform the employee in the store or directly contact Diverse Club customer service, by reporting the problem via e-mail: biuro@diverseclub.com. It is necessary when informing about the damage or loss of the card to provide the card number, name and surname, and the address data accordingly with those provided during card registration process.
5.2. After receiving the information about the card loss or damage, employees of the Diverse Club customer service will lock the lost / damaged card.
5.3. DIVERSE is not responsible for unauthorized use of the card by a third party within 48 hours after receiving the information by the Diverse Club customer service.
5.4. In case of finding the lost card, which loss was reported by the Participant, immediately inform the Diverse Club customer service.
6. Special provisions and reservations
6.1. Participant should contact the Diverse Club customer service about changing their name, surname, phone number or e-mail address within 10 working days since the moment of change. The consequences of failure to comply with this requirement shall be borne by the Participant.
6.2. In case of violation of the terms & conditions by the Participant, DIVERSE reserves the right to cancel the card and/or exclude the Participant from the Program.
6.3. DIVERSE reserves the right to announce temporary promotions or actions, also when in cooperation with a third party.
6.4. Participants may use only one Diverse Club card. If the participant uses several Diverse Club cards, DIVERSE (ETOS S.A.) reserves the right to cancel all cards belonging to the given participant.
6.5. Program Participants are not entitled to any claims against DIVERSE resulting from being a participant alone.
6.6. Terms & conditions of the Loyalty Program are valid for a period of 6 months. After 6 months ETOS S.A. reserves the right to verify provisions of the terms & conditions and discount rules, or extending the duration of the terms & conditions in their current form. 7. End of the Program
DIVERSE may freely decide about ending the Program, using appropriate forms of information and notifications.
8. Diverse Club customer service
All information about the Program and using the card is provided by the Diverse Club Customer Service. Inquiries should be sent to the e-mail address: biuro@diverseclub.com.
9. Processing personal data
9.1. The administrator of your personal data is DIVERSE, whose identification data is specified in point 1.1. of these terms & conditions. Personal data provided during the Diverse Club Loyalty Program registration process are processed by the administrator in order to fulfil the obligations set out in these terms & conditions, and in accordance with applicable regulations, including pursuant to the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/WE (General Data Protection Regulation; hereinafter RODO).
9.2. Providing the personal data is voluntary, nevertheless necessary for participation in the Diverse Club Loyalty Program.
9.3. The legal basis for the processing of your personal data by the Administrator is Article 6 item 1 letter b RODO, according to which processing personal data is necessary to perform the contract, to which the data subject is a party, or to take action at the request of the data subject before concluding the contract.
9.4. During the registration process Customer agrees to processing their personal data in order to examine the opinion on the level of satisfaction with the purchase, agrees to the processing of personal data for promotional and marketing purposes, as well as to receive commercial information by electronic means. In these cases, the legal basis of the processing is Article 6 item 1 letter a RODO i.e. consent to the processing of personal data for one or more specific purposes. Revocation of previously granted consents, listed above, or objecting to the processing of personal data for marketing purposes is unambiguous with withdrawal from participating in Diverse Club Loyalty Program.
9.5. The administrator declares, that personal data of the Participants may be transferred to entities cooperating with DIVERSE for marketing purposes, in particular for the purpose of providing information on products, promotions and commercial offers sent via e-mail or SMS.
9.6. Personal data obtained during registration and while participating in the Diverse Club Loyalty Program are stored for the duration of participation in this program.
9.7. You have the right to demand from the administrator access to your personal data, their rectification, erasure or restriction of processing, the right to data portability and the right to lodge a complaint to the supervisory authority.
