
The Diverse Gift Card is the perfect choice for a present that will definitely make the recipient happy. The gift card can be purchased and used in Diverse stationary shops.
1. For the purposes of these Terms and Conditions, the following definitions apply:
· Seller / Issuer – ETOS Spółka Akcyjna, headquartered in Gdańsk, at Bysewska Street 23, registered in the Register of Entrepreneurs maintained by the District Court Gdańsk-North in Gdańsk, VII Commercial Division of the National Court Register, under KRS number 178415, NIP 584-030-32-02, with a share capital of 55,055,102 PLN (fully paid).
· Customer – a natural person, including a Consumer, who is at least 18 years old and has full legal capacity, as well as a legal entity or an organizational unit without legal personality that has legal capacity granted by special provisions and has purchased the Diverse Gift Card from the Seller.
· Diverse Gift Card – an electronic voucher in the form of a plastic card or a numeric code with a specified nominal value, issued to the bearer, identified by a unique code, allowing the holder to redeem it exclusively in a Diverse Store to purchase goods offered by the Seller in accordance with these Terms and Conditions.
· Online Store – the website available at www.diversesystem.com, through which the Customer can place orders via distance selling for goods offered by the Seller, leading directly to the conclusion of a distance Sales Agreement, specifying the type and quantity of goods covered by the Agreement, as well as access to other Store services.
· Diverse Store – a Diverse-brand physical store operated within the Republic of Poland by the Seller or a third party on its behalf.
· Goods – a tangible item from the Seller’s offer in the Diverse Store that is the subject of the Sales Agreement.
· Sales Agreement – a contract of sale as defined by the Civil Code, concluded between the Seller and the Customer in the Diverse Store, covering the purchase of goods.
· Terms and Conditions – these Terms and Conditions governing the issuance and use of the Diverse Gift Card.
· Civil Code – the Civil Code Act of April 23, 1964.
· Personal Data Administrator – Etos S.A., headquartered in Gdańsk, at Bysewska Street 23.
2. By issuing a Diverse Gift Card to the Customer in exchange for a specified amount of money, which becomes the Issuer's property, the Issuer commits to providing the Customer with a Gift Card of an equivalent nominal value to the amount received.
3. The Diverse Gift Card is issued with a nominal value ranging from 10 PLN to 5,000 PLN.
4. The Diverse Gift Card can only be used to purchase goods offered by the Seller in a Diverse Store and must be used within its validity period as stated on the card. When purchasing goods, the card's nominal value will be reduced by the corresponding transaction amount. If the total purchase price exceeds the available balance on the Gift Card, the Customer must pay the remaining amount using another payment method. If the purchase price is lower than the remaining balance, the unused funds remain available for future purchases within the card's validity period.
5. The Diverse Gift Card can be used multiple times during its 12-month validity period from the date of issue.
6. The Diverse Gift Card cannot be used to purchase goods in the Online Store.
7. Unused funds on the Diverse Gift Card cannot be exchanged for cash.
8. The Diverse Gift Card cannot be returned to the Issuer.
9. If a Customer uses the Diverse Gift Card and later withdraws from the Sales Agreement, they will not receive a cash refund for the value used. Instead, the refunded amount will be returned to the Diverse Gift Card.
10. The Issuer has the right to refuse the redemption of the Diverse Gift Card in the following cases:
· If the card has expired.
· If there is a technical inability to process the transaction, including system failures preventing communication with the Issuer's IT system or damage to the Gift Card preventing data retrieval.
The Issuer is not responsible for any inability to use the Diverse Gift Card due to circumstances beyond their control, including, but not limited to, technical issues in Diverse Stores that prevent electronic or telephone connection to the Issuer’s IT system. In such cases, Customers will be informed by store staff about the nearest location where they can successfully redeem their Diverse Gift Card. If the issue affects the entire Diverse store network, the Customer will have the option to leave contact details to receive an update once the issue is resolved. If personal data is provided, it will be processed with the Customer’s consent by the Seller as the Personal Data Administrator, in accordance with the General Data Protection Regulation (GDPR) (EU) 2016/679 and the Personal Data Protection Act of May 10, 2018.
11. Customers can check their current Gift Card balance directly in a Diverse Store.
12. Once issued, the Issuer is not responsible for any loss, theft, or unauthorized use of the Diverse Gift Card by a third party, if such an event occurs for reasons beyond the Issuer’s control.
13. The Diverse Gift Card is not a payment card, financial instrument, or electronic money instrument.
14. Complaints regarding the Diverse Gift Card can be submitted: In Diverse stores, By mail to the Issuer’s registered office address. A complaint should include the Customer’s contact details to allow the Issuer to respond, as well as a description of the complaint's basis. Complaints will be reviewed by the Issuer within 14 days of receipt. Submitting a complaint does not limit the Customer’s rights under applicable law.
15. By submitting a complaint and providing personal data, the Customer consents to the processing of their personal data by the Seller (Etos S.A.), headquartered in Gdańsk, at Bysewska Street 23, for the purpose of resolving the complaint. The Seller ensures the protection of personal data and declares that it will process the data in compliance with the General Data Protection Regulation (GDPR) (EU) 2016/679 and the Personal Data Protection Act of May 10, 2018. The Privacy Policy outlining the principles and scope of personal data processing is available at: https://diversesystem.com/pl/sklep/polityka-prywatnosci. Personal data will be processed based on customer consent (Article 6(1)(a) GDPR) for complaint resolution contract performance (Article 6(1)(b) GDPR). The Customer has the right to: Access their personal data (Article 15 GDPR), Withdraw consent for data processing (Article 7(3) GDPR), Correct inaccurate data (Article 16 GDPR), Request data deletion (Article 17 GDPR), Restrict processing (Article 18 GDPR), Object to data processing (Article 21 GDPR), Not be subject to automated decision-making, including profiling (Article 22 GDPR), Request data portability (Article 20 GDPR), File a complaint with the Polish Data Protection Authority (PUODO).
